Federal Court Orders Freedom of Kilmar Abrego Garcia from ICE Custody

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks lawful basis.

"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The case originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. Following his return to the United States to answer alien smuggling charges, he was held in immigration custody.

In her decision, the court pointed out that the government lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
